RENTAL AGREEMENT

RENTAL AGREEMENT, TERMS & CONDITIONS, DISCLAIMER AND INDEMNITY
WHEN STAYING OVER AT VILLA VUE


Cancellation Policy:

• In the event of this agreement being cancelled for any reason whatsoever, shall
the Tenant (“the Tenant/Guest/s”) only be entitled to a full refund, of the amount
deposited, on the condition that the notice of cancellation falls within 48 hours after
the booking has been made.
• No refunds for cancellations, for any reason whatsoever, will be considered or
issued after 48 hours of the booking.
• Full payment will also be charged in case of early curtailment or in case of a no show.


Payment Policy:
• Bookings are taken in advance but are only confirmed on receipt of payment,
within the next 3 working days into the account provided on the quotation.
• The booking will automatically be deemed cancelled if payment has not been
received by the due date.
• No persons other than those quoted for are permitted to share the accommodation.


Change of booking dates:
• Changes of booking dates may be requested.
• Change of booking dates will only be considered and authorized once-off and will
be subject to availability of the property.
• The owner gives no warranty regarding the availability of alternative booking dates
whether express or implied.

Check-in and Checkout times:
• Check-in is from 3:00 pm.
• The booking will be deemed cancelled if not taken up at 7pm unless prior
notification has been given of late arrival.
• Checkout time is strictly at 09:00 am at date of departure.
• The owner may consider and allow a change in check-in upon request.


Security Deposit and Inspection :
• A Security deposit of R 1500.00 (One Thousand Five Hundred Rand) is payable
at date of booking.
• The property will be inspected within a reasonable time after check-out on date of
departure where after the Security deposit will be issued or retained/ where after
damages will be communicated to management.


General Rules, Penalties and Fines:
Failure on the part of Tenants, guest and or guest of the Tenants to comply with the
following house rules will result in penalties as stipulated:

• No pets allowed – R1500 fine applicable
• No smoking including, vapes and or hubbly bubbly is allowed – R1500.00 fine
applicable
• No events and parties are allowed on the premises – R1500.00 fine applicable
• No all men / or all women (i.e., bachelor or bachelorette) parties allowed – R
1 500.00 fine applicable.
• No parties for youngsters (children under the age of 18 years) and large groups
are permitted – R1500.00 fine applicable
• No noise after 10:00PM – R 1500.00 fine will be issued after first complaint
received.
• No more than 5 people allowed – R1500 fine applicable. You can make special
requests for more guest before arrival which will be considered at an additional fee
per person.


Important Notices:
• Villa Vue is located in a quiet coastal village. Please respect the quiet culture within
the area.
• Should larger groups choose to socialize on the top floor, please keep the back
door at the braai area closed to ensure the noise level stays at a minimum.
• Kindly close windows when you are not in the house.
• Whilst the house and general area it is very safe, always remove all valuables from
your vehicles and keep it locked in order to prevent petty crime which could not
only result in a financial loss but also be a cause inconvenience on the off chance
that it may occur. Refer to the Indemnity clause.
• The outside beams are additional security to alert you from the onset of possible
crime therefore we suggest that you activate the outside beams not only to protect
your vehicles but also yourselves as well as your valuables inside the house.

• Ensure all fires are extinguished before going to bed. Refer to the Indemnity
clause


Guest Behavior and Children:
• The Owners have the sole discretion in determining whether behavior and or
appropriateness of the behavior is acceptable or not. The Owners` reserve the
right of admission, and should guests behaved inappropriate steps will be taken.
• The house is suitable for children and children of all ages are welcome. Please
keep in mind that the house is a three-storey house and therefore children must
be supervised at all times.
• Children under the age of 14 years shall always be under parental supervision indoors and outdoors.
• Please monitor misbehaviors of your children to prevent any breakage or damage
to the building, contents of the building or your children

Guest / Booking requirements:
• In the case of a group of people the representative accepts this Agreement, Terms
& Conditions, Disclaimer and Indemnity on behalf of all members in the group.
• Guests might be expected to prove their identity by showing a valid passport or
identity document and must complete the booking procedure.
• The owner supports the right of personal privacy and corporate security on the
internet. The owner will never sell or market names, e-mail addresses, or any other
privileged information about clients or guests.


Disclaimer notice & Indemnity for Guests:
• In the case of a group of people the representative agrees to this Agreement,
Terms & Conditions, disclaimer and indemnity on behalf of all members in the
group.
• The Guests, their visitors, their own children, family and friends of their visitors
(“the Tenant/Guest/s) enters and attend the property/premises at their own risk.
• The Proprietor, its agent/s and /or its employee/s (“the Owner /Proprietor”) shall
not be liable for, and the guest/s, (“the Tenant/Guest/s) hereby waive/s and
abandon/s any claims of whatever nature including but not limited to that for theft,
injury, death loss or damage of whatever nature, against the Proprietor, whether
arising from the Proprietor`s default, negligence or otherwise.

• The Guest/s, in addition to the aforesaid, hereby indemnify the Proprietor against
any claim which may arise from whatever nature, whether arising from the
Proprietor’s default, negligence or otherwise.
• Whilst every endeavor is made in terms of the above recommendation to provide
for the exclusion of and Proprietor’s liability, such liability or exclusion thereof is
never absolute and is always subject to a matter of degree and the application of
an appropriate courts discretion.
• It should also be borne in mind that the courts` discretion is applied judicially to the
credibility and worthiness of appropriate evidence.
